A Criminal Law for <scp>Semicitizens</scp>

A significant number of influential philosophical theorists punishment argue that only those who enjoy the status citizenship in a political community can legitimately be punished by polity. Yet, strength this approach wanes when these scholars treat individuals clearly do not respond to their idealised conception (such as asylum seekers, disenfranchised offenders, and tourists) if they were fully fledged citizens. This article argues ‘citizen criminal law’ theoretically feasible today's world it abandons binary position between ‘full citizens’ ‘noncitizens’ recognises everlasting presence certain types ‘semicitizens’.
